Welcome to Door County Kayak Tours. These Terms of Service (“Terms”) govern your use of our website at doorcountykayaktours.com and
your purchase of tours, rentals, gift cards, and merchandise from Door County Kayak Tours LLC (“we,” “us,” “our”). By booking a tour or
rental, using our website, or signing up to receive communications from us, you agree to these Terms.
If you don’t agree with these Terms, please don’t use the site or book with us.
1. Who We Are
Door County Kayak Tours LLC is a Wisconsin limited liability company operating guided kayak tours, kayak rentals, e-bike rentals,
and retail sales in Door County, Wisconsin.

2. Bookings and Payment
Tours and rentals are booked through our booking partner, FareHarbor. Payment is collected at the time of booking via credit card.
By booking, you confirm that the information you provide (name, contact info, payment) is accurate and that you’re authorized to use
the payment method.
Prices listed on the site are in U.S. dollars and may change without notice. Once your booking is confirmed, your price is locked
in.
3. Cancellation and Refunds
Customer cancellations: You may cancel or reschedule any tour or rental up to 24 hours before your scheduled start
time for a full refund. Cancellations made less than 24 hours in advance are non-refundable, but we’ll always try to reschedule when we
can.
Cancellations by us: Weather, water conditions, equipment issues, or staffing shortages occasionally force us to
cancel or reschedule. If we cancel your booking, you’ll get the choice of a full refund or rescheduling at no charge. We’re not
responsible for travel, lodging, or other costs you may incur related to a cancellation.
No-shows: Failure to arrive on time without notice is treated as a same-day cancellation and is non-refundable.
4. Assumption of Risk and Waiver
Kayaking, paddling, and biking involve inherent risks, including but not limited to capsizing, hypothermia, sun exposure, injury,
drowning, weather hazards, and equipment failure. By booking with us, you acknowledge these risks.
Every participant (or their legal guardian if under 18) is required to sign a separate liability waiver before participating in any
tour or rental. Refusal to sign the waiver means we can’t allow you to participate, and standard cancellation rules apply.
5. Participant Conduct
We reserve the right to refuse service, end a tour early, or remove a participant without refund if they are visibly intoxicated,
behaving unsafely, ignoring guide instructions, or putting themselves or others at risk. Our guides have full authority over on-water
and on-trail decisions.
6. Gift Cards
Gift cards are non-refundable, non-transferable for cash, and do not expire. Lost or stolen gift cards cannot be replaced.
7. SMS / Text Message Program
By providing your mobile phone number to us, whether at online checkout, in person at our Jacksonport shop, by texting our business
number, or through a website form, you consent to receive text messages from Door County Kayak Tours. These messages may include:
- Booking confirmations and reservation reminders
- Weather, safety, and schedule updates
- Customer support replies
- Marketing and promotional offers (only if you opted in to marketing messages)
Message frequency varies depending on your booking activity and the time of year. Message and data rates
may apply per your mobile carrier’s plan.
You can opt out at any time by replying STOP to any message. You can get help by replying HELP or

Consent to receive SMS messages is not a condition of any purchase. We do not sell, rent, or share your mobile

8. Website Use
Our website and all content on it (photos, videos, text, logos, branding) are owned by Door County Kayak Tours LLC or our licensors
and are protected by U.S. copyright and trademark law. You may not copy, reproduce, or republish our content for commercial use without
written permission.

9. Photos Taken on Tour
We sometimes take photos and video during tours for marketing use on our website, social media, and ads. If you don’t want to appear
in our content, let your guide know before the tour starts and we’ll work around you.
10. Limitation of Liability
To the fullest extent permitted by Wisconsin law, Door County Kayak Tours LLC and its owners, employees, guides, and contractors are
not liable for any indirect, incidental, or consequential damages arising from your use of our website, tours, or rentals. Our maximum
liability for any claim related to a booking is limited to the amount you paid for that booking.
Nothing in these Terms limits liability for gross negligence, willful misconduct, or anything else that cannot be limited under
applicable law.
11. Governing Law
These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law rules. Any disputes will be
resolved in the state or federal courts located in Door County, Wisconsin.
12. Changes to These Terms
We may update these Terms from time to time. The “Last updated” date at the top tells you when. Continued use of the site or booking
with us after a change means you accept the updated Terms.
